Joann was taken to Phoenix Abrazo hospital by a friend as she was complaining of feeling strange and disoriented. She was admitted into the hospital on that same day. A spinal tap was performed on the 30th, MRI scans were performed shortly thereafter.
August 1, 2016
Joann’s brother Dennis Kloss who resides in Haslett, Michigan was her Power of Attorney. Though Joann had yet to be officially deemed incapacitated at this point, he began taking charge and overriding her own known wishes and decisions regardless of this fact. Moreover, as the chain of events unfolds, it will be seen that Dennis learned on August 4th that this tumor was in an operable state upon its discovery yet made no effort to pursue that surgical option. He sent out this email at left from his home in Michigan explaining that Joann had the MRI scans completed, and that a brain lesion, or tumor, was discovered during the procedures. He states that JOANN will meet and discuss with HER neurologist and neuro-surgeon a treatment plan of action the next morning. He then further states that HE and his wife, Dr. LYNN KLOSS are considering the options they might approve for Joann. Again, keep in mind, that at this point Joann had yet to be declared mentally incompetent in any way, yet they blocked a recommended and badly needed biopsy until Lynn Kloss (2000 miles away) reviewed the MRI’s and gave her approval to proceed with any lifesaving efforts. Dr. Kloss’ actions of interfering with, or deciding on treatment procedures for her sister-in-law (a family member) is in direct violation of the AMA code of ethics, specifically § (8.19). Moreover; she was operating FAR outside of her scope of training, practice, and field of expertise. Dr. Kloss is an Occupational Medicine practitioner, NOT an internist or neuro-surgeon. Her involvement and questioning of diagnostic and treatment procedures that were recommended by specialists attempting to care for Joann only served to cause critical delay.These actions could be likened to a flight attendant telling an airline captain how to conduct flight operations during an emergency situation.
August 4, 2016
Dennis got around to forwarding a text informing family and friends what was going on with Joann.
He explained to everyone that he had specifically asked Joann’s internist if the tumor that was discovered on the MRI scans was operable. As can be seen in this text the doctor’s answer to that question was YES.
So, on August 4, 2016, Dennis and his wife DOCTOR Lynn Kloss both became fully aware that Joann’s tumor was in an operable state AT THAT TIME.
One extremely troubling issue that this (the August 4th text) brought to light was that in the earlier communication (lower right) from Dennis dated three days prior on August FIRST, he indicated that he and his doctor wife who practices only in the field of occupational medicine, NOT neurology, were already aware of the need for a biopsy, yet had made up their minds that they would NOT grant approval for a biopsy until HIS WIFE, who was 2000 miles away from Jo and her team of specialists, had the chance to review the M.R.I. scans that were performed on Joann in Phoenix.
To be clear, Dr. Lynn Kloss was already interfering with and causing delay to the medical procedures that needed to be done in an effort to save the life of her sister-in-law and family member. Again, these actions were in direct violation of the American Medical Association’s code of ethics.
August 8, 2016
Dennis sent out an email from his home in Michigan complaining that one of Joann’s MANY local Phoenix friends had hurt his feelings by asking him why he had not found it necessary or important to be in Phoenix yet to address his sister’s urgent medical needs in a more timely manner. Dennis is a financially independent person. He does not have a job. His many “reasons” for delayed travel included (1) His doctor wife had to go with him to keep him mentally balanced and she could not get off work until the end of the month. (2) He was afraid to have his cell phone in airplane mode for the three and a half hour flight, because he might miss an important call from the hospital. And (3) which is the most confounding, and illustrated to the right, he was afraid that if he showed up he would have been STUCK??? taking care of his gravely ill sister/client, and unable to do much else. Just what else was it that he wanted to do? Wouldn’t the entire goal of the trip had been to take care of his sister’s urgent life or death needs? August 12, 2016
The upper part of this image displays part of the letter Dennis sent out on August 7 explaining Jo’s discharge options. Note that three of her four possible options were to live in a private residential home. The entire letter can be viewed by clicking here. After the DELAYED biopsy, the pathology results revealed that Joann was fighting glioblastoma, the most aggressive form of brain cancer known to medical science. Now armed with this new information, Dennis sent out another email on August 12 updating everyone on his and his doctor wife’s new plans for their long awaited and overdue first trip to Phoenix. In this message he stated that he had arranged to have Jo institutionalized, thus eliminating his fear of being “STUCK” taking care of Jo when he finally did arrive in Phoenix. He also indicated his plans to have “lots of appointments lined up” with attorneys and real estate agents in order to begin liquidation of his sister’s assets as soon as he got there. He made NO mention of speaking to any doctors, or even to Joann for that matter. Both he and his wife seemed to have been viewing Joann as already deceased now that they had her safely locked away at the Stratford. His entire focus had shifted away from his client/sister’s medical needs to one of strictly avoiding personal financial hardship to himself. He further affirmed that he would be waiting until the END OF THE MONTH before he traveled to Phoenix, which is exactly what he did. Again, he claimed that his doctor wife needed to go with him in order to keep him mentally balanced (medicated) but she could not get away from her job until then to deal with a family member’s life and death emergency. This delay allowed Joann’s very aggressive disease to spread completely un-abated for an entire month. So just to make sure it is clearly understood, a known, and very aggressive tumor that was deemed operable at the time of its discovery, was now being allowed to spread without any kind of intervention approval or efforts by Dennis and his doctor wife for the greater part of an entire month.
AUGUST 12, 2016 CONT.
On the very same day that Dennis and his wife announced their new plans for Joann’s home and other assets, Joann was reaching out to friends for information from her hospital bed in Phoenix. Dennis was still in Michigan. His communications with her had slowed to a trickle since he was now busy at his home making arrangements to liquidate her estate, even though she was still very much alive and wanting to fight for her life. His focus was no longer on lifesaving efforts for Joann, it was on his personal financial well being… Note how Joann stated she wanted the problem “removed” if possible. She was absolutely in favor of surgery. The tumor was still spreading un-abated at this point, yet Dennis made it clear that he would not be arriving in Phoenix any time soon. The email displayed in the section above are his own words, they cannot be denied. Once Dennis learned that Joann was communicating with her friends, he began banning people from visitation and communication with her. He did not want her to become aware of his plans and actions from anyone. He even went so far as to ban clergy from seeing her. Dennis Kloss stopped at absolutely nothing when it came to keeping his sister forcefully isolated from the outside world. August 12 -- 14, 2016
By this time Dennis himself stated that he was avoiding calls from the hospital. Ironic to say the least, since this was one of the excuses he had used NOT to fly to Phoenix earlier. He was afraid to be without cell service for the three and a half hour flight in case the hospital needed to get in touch with him. Now however; it was okay not to talk to the hospital since it would interrupt his new path of activities. His main concern during this string of texts was locating a particular guitar stored at Joann’s home that belonged to her late EX-husband, Tom Powers. He had been coveting the instrument ever since Jo had become ill, even though it legally belonged to Tom’s only surviving relative, his sister. It did not belong to Joann, and it certainly did not belong to Dennis. That made no difference to him however, he wanted it and had stated he was going to take it on more than one occasion.
The image at lower right serves to illustrate just how obsessed he was about possessing this instrument. In spite of the fact that he had been claiming for days on end that Jo was too ill to have visitors or phone calls, when it came to HIM finding out where this guitar was, he was perfectly willing to allow her to be disturbed.
August 15 and 16, 2016
Dennis was so relieved to see that one of Jo’s local Phoenix friends was able to eventually locate the instrument inside her residence he had to text out to people from his Michigan home that it had been found. He wanted this thing so badly for himself, without her knowledge or permission, he ordered the locks on his sister’s home to be changed. He further instructed people to not even allow his sister back into her own home at that point. He insisted on keeping her as isolated from the truth and outside world as much as possible in the facility that he had forced her into. He further explained that he, not his sister, was compiling a list of people that he would allow to visit with Joann. A fact that he later attempted to deny when he found himself being accused of forced isolation of Joann. He did in fact however; continue to keep her forcefully isolated against her will throughout the entire four remaining months of her life. Very clear evidence of that fact is displayed further down this page and in the evidence section of this site. These texts are his own words, he is the author of these messages. He cannot deny that he ever communicated these things.
His very act of ordering the locks to be changed on her home, behind her back and without her permission, was illegal. The fact that he denied her entry into her own home, or her use of her own home in any manner, meets the legal definition of property theft in the state of Arizona, power of attorney status included. Furthermore, if the property involved is valued in excess of twenty-five thousand dollars, then such an action constitutes a class 2 FELONY.
August 24, 2016
Still from his home in Michigan, Dennis announces that he will finally be arriving in Phoenix and take Joann to discuss surgical possibilities on August 30th. This is one FULL MONTH after the tumor was initially discovered and deemed to be operable at THAT time. During this completely avoidable delay Jo’s tumor had been growing and spreading entirely un-abated. As can be seen at the bottom of his text message displayed at the right. Within this text he stated that Jo had to be moved into a memory care unit during this delay. Obviously her symptoms were rapidly getting worse indicating that the tumor was spreading aggressively, as glioblastoma does, and time was very critical. In spite of this, Dennis remained true to his original plan NOT to show up in Phoenix until the END of August. Had Dennis acted properly by allowing the surgical removal of as much of Jo’s tumor as possible when it was in an operable state, Joann would very likely not have been in such life threatening circumstances later in the month. This was a complete breach of a P.O.A.’s fiduciary duty to place his client’s needs, and her very life, at the forefront of his actions.
As the video presented at the right is viewed it will become clearly evident that Dennis’ failure to act towards Joann’s need for prompt surgical intervention was inexcusable and unconscionable.That lack of timely action by him AND his doctor wife was the single strongest contributor to the premature death suffered by Joann. She only survived for four and a half months from the date that her operable tumor was initially discovered.
Early september 2016
Once Dennis did finally get to Phoenix, he had the opportunity to get a first hand look at Joann’s cell phone. He was furious when he discovered that his sister had been communicating with her local friends.
As can be seen at right, he discovered that in mid August she had been trying to make arrangements to obtain in home supervision so she could rehabilitate in her own familiar surroundings after the surgery she was still hoping to undergo.
Of course Dennis’ month long delay in meeting with Joann and her neuro-surgeon to even discuss surgery had closed the door on that option for Jo. He certainly did not want her to become aware that his failure to act swiftly had caused the surgery option to now be off the table and therefore GREATLY reducing her odds of survival.
His method of preventing such information from being revealed to Joann was then stepped up by him taking her smart phone away from her. These images at the right display HIS text conversation with one of Joann’s longtime friends (35 years-plus) regarding not only Dennis keeping Joann’s cell phone in his possession and away from Joann, but also his more than obvious actions of destroying her intellectual property, and prohibiting her contact with family and friends that Dennis did not approve of. The man stopped at nothing in trying to prevent his sister from learning of his incompetence and negligence. Even if that meant depriving her from the comfort, love, and support she so badly needed at this time in her life.
Dennis Kloss THEN BEGAN DESTROYING HIS SISTER'S INTELLECTUAL PROPERTY
With her cell phone now in his hands he was then able to access Joann’s social media accounts since her phone was set up to access these accounts with a simple tap of the screen and no need to enter passwords. Of course once logged in he had the ability to then change her passwords to one that only he would know. This is exactly what happened and was verified by Facebook itself when its security personnel were eventually contacted by concerned friends regarding this new and unusual activity on Joann’s page. His destruction of Jo’s intellectual property had taken place over time period of many weeks. It had continued well after his five day visit to Phoenix had ended, and he was back at his Haslett Michgan home. Facebook themselves verified the accessing I.P. addresses where password changes, friend deletions, friend requests, post deletions, new postings, and other activities that had taken place as being in Haslett Michigan. The records for this account have been safely retained in the event the issue should ever need to be revisited.
MID SEPTEMBER UNTIL FACEBOOK TOOK JOANN'S PAGE DOWN TO END DENNIS' CRIMINAL CYBER ACTIVITY
Though true negativity never really surfaced on JOANN’S page, it must have been quite a relief to now have Joann’s social media account firmly in his control. Not only could he now permanently prevent her from staying informed, he could also destroy all of her cherished messages, posts, and photos under the guise that they were harmful and upsetting to her. The true fact is they were only harmful and upsetting to him due to a few inquiries regarding visitation, and whether or not she felt like having visitors. He figured he could destroy this material and then never be forced to deal with it again. It was only AFTER his commandeering of her page that people began to post complainants about HIS destruction of HER messages, photos, and get well wishes. Copies of the data that do reflect the accessing I.P. addresses from where this activity took place continue to remain retained and will remain archived for review as future events happen to arise.
It is clear and extremely problematic that Dennis Kloss was focusing all of his efforts towards covering his tracks and nothing more. He did not want Jo communicating with anyone due to the fear that his negligent handling and lengthy time delays regarding her treatment needs would be exposed to her. He was ignoring his fiduciary duty to place his sister’s health and welfare needs at the very forefront of his actions. His only interest was manipulating Jo’s concerned friends and family and seeking revenge against anyone who questioned his activities. As illustrated here, negativity only began to appear AFTER Dennis Kloss began destroying his sister’s pages, and preventing her use of her own account.
If, as he and his attorney claimed, comments left on Joann’s page were upsetting to her, why then, did Dennis Kloss find it necessary to start adding “new friends” of his unilateral choosing to her account?
The question that must be answered here is would Joann had become upset if these “new Facebook friends” had not been added to her account? Especially while she was trying to overcome a life threatening battle with brain cancer? It would be impossible for any right minded person to contend that these new friends were added by Dennis, to preclude harm to his sister.
The ONLY reason Dennis chose to make these bad faith, deceptive, immoral, and dishonest actions was to recruit these “new friends” into his personal illusionary war against Joann’s concerned and close friends. Dennis did not even know the vast majority of the people he chose to treat with such vindictiveness. He had NO idea of the length, width, or depth of his sister’s friendships with any of these individuals. He only knew, or in most cases simply suspected, that some of them had questioned his clearly negligent handling of Jo’s needs. Especially his total failure to act within in a reasonable time frame.That was the only criteria he used to keep all of them away from her, regardless of the comfort, strength, and support these close friends AND family could had offered to Joann.
The images to the right illustrate exactly what was occurring. The image dated September 25, 2016 is of Joann’s home page. It can be seen that the announcement was made that Joann and a Mr. Rob Quinn, formerly of Detroit, but now residing in London England, just became Facebook friends. Given the fact that this person is fifteen years younger than Joann (just like her brother Dennis is) has an automotive marketing background with strengths listed to include development of high level strategic partnerships and collaborations with skills in the mobile and social media fields. (complete bio can be viewed here) it is no wonder why Joann needed to become Facebook friends with him right in the middle of her life and death battle. Imagine the harm that she would not have been “precluded from” had this friendship not been created somehow.
As can also be seen to the right, it was no mere coincidence that “Mr. Quinn”? immediately began posting to Joann’s page in an attempt to defame and damage the credibility of Joann’s sister-in-law and her husband who both happened to very close to Joann and very concerned about the lack of treatment options being pursued by Dennis Kloss, AND his lack of his timely action . “Mr. Quinn”?? flimsily attempted to discredit Jo’s sister-in law and her husband by pointing out they had been involved with a discrepancy over a business contract that was created in 2007 that had absolutely nothing to do with Joann or her life. The desperation is actually quite pitiful, yet laughable at the same time. How on earth could any normal thinking person contend that this had any relevance to Jo’s medical needs? It is also troubling to note, that above this message, Dennis Kloss had posted AS HIS SISTER a message urging everyone to read about this newfound and “damaging” information. Dennis’ post (as if by Joann Powers) is not even worded in first person. The only thing criminal going here was Dennis Kloss commandeering his sister’s social media account and using it as a weapon by impersonating Joann. Had SHE been aware of her brother’s action of doing this, THAT would have upset her, not the “nasty posts” (shown in the next section below) that Dennis and his attorney Jerome Elwell claimed were upsetting to Jo.
THOSE "NASTY" POSTS
These are only some of the extremely caring, loving, and supportive messages that family and friends were leaving for Joann. As anyone can plainly see, these messages must have been extremely upsetting to her. No wonder Dennis felt the urgent need to destroy them. As has been stated, the fact of the matter is, that Dennis simply did not want to leave any channel of communication to the outside world available to Joann. Again, his prime motive for this was to keep knowledge of his actual activities from being revealed to his sister. The man stopped at nothing to accomplish this. He even went so far as to CUSS OUT an elder named Brother Robert from Jo’s church for visiting and communicating with Joann. A secondary benefit to Dennis was that by HIM now controlling Joann’s account he had an additional weapon in his arsenal to use against Jo’s concerned family members and friends. He now had total control over their ability to communicate with her, and he used this weapon extremely well until FACEBOOK put an end to it.
His mental instability demanded that they all be punished for their concern and alarm at his belated, negligent, and criminal treatment of his sister. He did not want them to know how she was doing, and in fact made a promise to all, that he would not even announce to anyone, including family members, if and when Joann lost her all too shortened battle with the decease she was attempting to overcome. Thanks to his and his wife’s involvement and delays, Jo’s battle was short, and her survival was never realized. Dennis remained true to his promise and never announced the date Jo’s passing to anyone, not even to his family. Her death announcement in local Michigan newspapers did not even mention the date of her departure. He had even instructed the staff at the institution she was isolated in to remain silent. This behavior, to control and punish, is unfortunately one of the traits that sociopaths do wield against anyone who does not concur with their demands or actions.
Sometime in mid December 2016 it became evident that Joann had lost her battle. It took the involvement of the Phoenix Police Department having to visit the institution she was in to conduct welfare checks on Joann in order to confirm whether or not she was still of this earth. This would have put a very large smile on the face of any mentally unstable, sociopathic, madman. The vengeance was his in his opinion. He got to serve his punishment upon those who questioned his almighty power. Namely the concerned family members, and true longtime friends of Joann Powers. Joann would have been extremely upset at his viscous treatment of her family and friends. This was another reason he wanted no communication between her and them while she was still alive.
One could be fairly certain that the fact his sister suffered an extremely premature and lonely death, separated from so many of her family members and true friends, was of no great concern to him. Sociopaths cannot differentiate right from wrong, good from evil, or personally experience remorse. Their mental abnormalities prevent that from being possible.
THE TRUTH OF THE MATTER
All of the posts and messages to Joann that Dennis destroyed were in fact of love and support. The ONLY location that any negative posts ever appeared PRIOR to his destruction of Jo’s page was on this private page. This PRIVATE page was created by one of Joann’s friends so that many, many, family and friends of Jo’s that Dennis had viciously alienated had a means to communicate with each other in an attempt to stay somewhat informed of her progress. Any post in that forum of a negative nature would have been the result of HIS action of isolating her. He has no one to blame for that other than himself. Had he acted in a normal and caring manner towards his sister, such as following her wishes rather than his own secretive agenda, he would not have felt threatened by his sister possibly finding out the facts of his actual actions. In other words he was very much in fear of her discovering that his month long delay in arriving to Phoenix, and his month long delay in meeting with Jo’s neuro-surgeon to map out any kind of treatment plan had closed the once open door for surgery that would have given Joann the best odds of survival. Joann was unaware of the fact that Dennis was keeping all but three of her friends, hand chosen and under gag order by Dennis himself, away from her and he insisted on KEEPING her unaware of that. His sole reason for destroying her intellectual property was to keep her from learning of the criminal isolation he had foisted upon her. A convenient side benefit for him was that controlling her account allowed him to use his own sister’s social media pages as a weapon against her concerned friends. As was illustrated, he was adding “new” friends of his choosing to her page. Then suddenly, these “new friends” began to post messages defaming Jo’s true friends, and also defending his sociopathic actions.
SADLY IN THE END
Dennis and his hired legal gun Jerome Elwell did manage to keep Joann from ever seeing all but one of her dear and close family and friends during the most difficult time of her life. That one person was Gale Rusu who flew in from Michigan, went to the Stratford, and demanded to see Jo, and would not take no for an answer from Dennis, who continued to be calling the shots from his Michigan home. Dennis caved in only this ONE time in allowing a loved one to see Jo. All others who ever attempted to visit her were consistently turned away by the Stratford staff per instruction of Dennis Kloss. She was denied the comfort and support they would have offered to her as she fought her all too shortened battle with the horrible decease that had come upon her. Dennis’ failure to act swiftly on his sister’s behalf was inexcusable. His failure to explore or approve surgical options when they were available in early August cannot be defended. The man is financially independent. He has no job to report to, and even if he did, his sister’s life was a stake and should have taken priority over anything he had to do in Michigan. His excuses for his late travel ran the gamut. My wife needs to come with me. I can’t be without cell service for a three and a half hour airplane ride, and the true winner!!! If I go, I will be STUCK taking care of Joann. One of the main goals of this site is to bring awareness of the horrible suffering that continues to take place due to P.O.A. abuse of their clients / family. Perhaps, some may even be held responsible for their deplorable actions towards others one day. The statute for many crimes runs seven years. In the case of causing premature death (manslaughter) there is no statutory limit.
